This paper analyzes the historical evolution of the regulation of the use of photographic reproductions of public cultural heritage starting from law no. 340/1965, which permanently introduced a fee on reproductions of artworks preserved in Italian public museums. Particularly, it focuses on the process of assimilation of the “concession fee” on reproductions, a typical expression of administrative law, to the copyright reproduction rights, raising issues of compatibility of the Art. 108 of the Code of Cultural Heritage and Landscape with the Art. 14 of Directive (EU) 2019/790 (Copyright Directive).
